I don't know about the green card status, but in this situation, there were some problems immagration.

If a person is here in the US or even in another country and marry an American, they CAN get a green card. It is an extemely long process. Most of the time, if they are here in the US, then the immigrant would have to do what is known as "adjusting status". They would be able to stay in the US while they get their green card. It doens't mean that they are guaranteed a green card, but with marriage they have the right to apply. If they are outside the US then they would file at the locale consulate and it can take over a year to be finalized.

You will be able to do what is called 'Adjustment of status', however you will need to be able to proove that you originally entered the US without the intention of getting married. It will also be alot more expensive than if you go back to your country and apply for a K1 (if not married yet) or a K3 if married already. The processing time for these visas vary from country to coutnry. I entered the US on a K1 from England and the whole process took about 5 months, but now I'm here legally and when I adjust my status for the greencard I will not need to worry about being denied etc ...

No. As you are a permanent resident, and the waiting period for a visa in the classification for spouses of permanent residents is 5 to 6 years, you can petition for him, but he is not eligible to adjust status to permanent resident. If you marry your boyfriend while he is in the U.S. as a visitor, it will not have any benefit for or effect on his status. He'll still be bound by the restrictions on the visitor status. He is more or less locked into the status on his I-94. He's a visitor. He's not allowed to work. And he can only stay for the validity period on his I-94. When it expires, his departure is required. If you were a U.S. citizen, the answer would have been different.

You are welcome to marry, but the visitor is not entitled to a green card just because they married someone who was already a guest of the United States.
