I received a check from the title company 1 year after buying my house. The check was the remander of a escrow account set up for the sellers to pay for assesments on the house. 6 months later they are now calling asking for the money back. Do I have to pay this back?

call a RE attorney... most title companies have "pads" in their accts. for errors.

If you believe in Karma, you may want to pay it back.

if it would be a "hardship" for you to pay it back, call the title company & negotiate for them to eat 1/2 of their mistake & you pay back the other 1/2.

It seems like u do agree that the check was sent to U in error. U should return it. I am sure it has been accounted for in somebody Else's taxes and books, and no amount of money is worth U getting red flagged and audited. I would return it. Good Luck

Whether you HAVE TO or not is irrelevant. You SHOULD because it was not your money to start with. If you were in their shoes ( and you never know what hardship they may be facing or just coming out of) you would want someone to be fair with you, wouldn't you? They may be in such a tight spot that they've not been able to get it together and are now pursuing every avenue they can to get hold of any money that is rightfully theirs just to jeep their heads above water!

yeah - you knew it wasn't yours - you should have called them back then to clear up the mistake.
