What are we talking about here? Boxing, UFC, or an abusive relationship? Are we trying to find a loophole in the whole "well, he doesn't HIT me" thing??
Come on, you know the difference. Abuse is abuse. No matter if it's kicking, biting, slapping, closed fist, open fist, choking, yanking, pushing...etc. Don't take it. Leave. If you don't, you are saying that it's ok to treat you that way.

Yes, if your partner is slapping, or kicking you it is considered assult and you need to contact the police now. It starts out kicking and slapping, then turns violent.in time I 've seen this first hand in my experience in law enforcement.
You need to get away from this loser.....IF this is what the question is really meaning.
