If someone dies without a will, they have died 'intestate'. The laws of the state where they lived are applied.

This is usually done in Probate or Surrogate's court, depending on the state.

Generally, the property is divided between the spouse [if any] getting a fixed percentage of the value of the estate and children [if any] splitting the rest.
