I just started this job as a night auditor June 4th, 07 and was doing well. Yesterday, I was called in for a "meeting" and was told I was terminated on these terms: Uncompliance with company policy with cashbank procedure. Some of it I understand and some of it I think it total BS and I need to express how BS this all is and what I can do legally for justice.

A.) They said that the last four shifts I was working I had over a hundred dollars each night missing from my cashbank. (little blue bags with my money.)
1.) My cashbank stayed on top of the money safe in the back office where I did my work each night. My banks WERE THERE BEFORE I ARRIVED TO WORK each night and the account assistant picked them up before my shift ended each morning.
2.) I was not trained or told otherwise to move my banks to another location. I used my best judgement to keep them there instead of in a drawer in the front desk, but...

since I do most of my work in the back office, I thought I would keep them back there.
3.) A week ago when I arrived to my work, I walked in the back office and noticed my bank was open on top of the same and immediately called my supervisor to tell him of the situation and to ask how much was supposed to be in the bank, because I never ever use it and was never told how much was in there.
4.) About an hour into my shift it gets busy with customers so I am at the front dealing with them. Consequently, the outlets close then and there are many people walking in and out of the back office to drop their own banks, and I didn't think I had to supervise them.
4.) When I was terminated I was told that I was fired for not taking care of my bank and it was my fault that it was not in camera's view. HOWEVER:
a.) Why wouldn't there be a camera in the back office ON THAT SAFE that many employees use daily.
b.) I was never told what to do with my bank ever.

I stick to my innocence in the situation and assume one of the people stole my money while I was dealing with customers in the front, and asked for proof. They said that I wasn't being fired for stealing but making it possible for someone to steal the money. They said that everyone that needed to be notified was, but I asked if any other employees were questioned and they said no.

They are in the process of cutting me a check for my hours worked which is also a bunch of BS. I worked there in the another department three years ago, and had direct deposit. So yesterday after the "meeting" I get a call from my old bank saying that over $600 is trying to be transfered to my closed account and I need to fix it. Why are they sending the money there aftere three years without me authorizing it again? Now it will take an extra week to get my money. This is so frustrating! I want some sort of justice for ruining my work history. I've never been fired or anything.

Oh and one last thing. They said it has been happening for four days....why was I given warning or talked about it before hand and just fired?

Normally, you could not do anything because you were a probationary employee. However, your employer made a big mistake by telling you why you were fired. Since you were given a reason, which you say is false, you can sue for slander, intentional inflection of emotional distress and wrongful discharge. If you had not been given a reason, you'd have no grounds. If you a female or a minority, you can file a complaint with your state's Human Rights Division or the federal EEOC.

Normally I agree with David. But he must be having a friday afternoon martini early.

In light of the facts you presented here you have absolutely no legal recourse and hiring an attorney to sue for slander or wrongful termination or anything else would be a waste of time and money on your part.

You, yourself, said the following:

There is nothing remotely suggesting that you have a case for slander. In fact, even if the employer had accused you of taking the money, which is NOT what you said, if the employer believed the statement and had no intent to harm, you could not sustain a slander suit.

The only advice you can take from this is to learn from your mistake and move on. And if you do hire an attorney, be ready to lose about $10,000 of your own money and get nowhere.

By the way, I am a 35 year practicing attorney and I would tell you the same thing in my office regardless of how much money you wave in my face.

Unless you have a contract or have been accused of a crime, you have little legal recourse. Nobody has to continue your employment. Legally, they don't even have to have a reason to fire you.

You can, of course, consult an employment rights attorney. Check the yellow pages for lawyers in that specialty. Many will do a telephone consultation for free.

Sounds like a lousy place to work anyway, if they're not training you properly nor dealing with missing funds as a problem to solve together. Try not to whistle on the way out. It pisses them off.

There is not much you can do, because you haven't worked there 3months and in some states that doesn't matter they have fire at will laws, but you could still collect unemployment comp.You can see if a attorney will take the case after hearing your story and only collect if judgment made in your favor. Other than that you are S.O.L I don't know anyone who wouldn't have fired you. Sorry.

Sorry, within the probation period, usually six months, they can let you go for ANY reason. Apparently, they think you are stealing $100 a shift...so that would be a good reason.

It doesn't matter if you are or are not...they can let you go, without justification.

It's BS, but it's the way it is. Sorry.

A) Hire a lawyer

B) Start a competitive business and drive them out of business

C) Move on to something bigger and better
