what if I was unaware if my car was stolen and dont know what happened and was returned in the exact same parking space it was stolen from with major damage and it seems as if it was in a car accident with another car what should I do

I am not sure you can do too much. You could try to report it stolen, but how do you prove it was stolen? I would at least report the damage to the police so that there is record of it. Mention to them about you think it was stolen and returned. They may have an idea of how to handle this.

This does happen by the way. I had a friend who had his truck stolen. He saw the person drive off in it. Later that night, the person brought the truck back to the parking lot. The police (this was in Houston) said this happens from time to time. The person needed a vehicle but did not want to steal it. It was sort of just borrowed. So, it is possible for a person to steal a car and bring it back and you never know it was stolen.

Call your local police department's non-emergency number and report it. Have your vehicle's documentation ready BEFORE the police officer arrives (VIN number, your insurance card, etc.).

After you are done getting the report filed with the police, immediately contact your insurance company. If you have comprehensive insurance, they will instruct you on where to bring your vehicle to have it examined for damages. If the damage is not too excessive, they will pay for your car to get fixed, minus your deductible. If the car's damage is too excessive, they will "total" it. If the car's paid off, you'll end up getting a check from the insurance company. The amount will be how much the car is worth, minus your deductible. If you are currently financing your car, the insurance will issue that money to your lien holder.

Even if you just had liability insurance, you still want to report the theft to the insurance company. You don't want to be liable for possible damages to other people's property while your car was not under your control!
