Because he is appealing it. All players do this and then usually drop the case at a point in which they are playing a crappy team so it's less likely that their team will lose. It's common.

Like other have mentioned before me, he is appealing the suspension. He will give up the appeal once Aramis Ramirez comes off the disabled list. The Cubs would be crazy to have Lee out of the lineup while Ramirez is still on the shelf.

They were both suspended 5 games but Lee is appealing his suspension so he doesnt have to serve his suspension until the appeal process is over.

He is playing because he appealed his suspension to try and get it reduced. It is a standard response from MLB players and a lot of times get suspensions reduced by a game or two in the process.

It is like if you are convicted of Murder, you get an appeal...except then you serve the sentence most of the time while waiting for your appeal.

A suspended player is free to continue playing while his appeal is heard. If his suspension is upheld, then he begins serving it with the next game.

He's appealing his suspension, so he's free to play until they make a ruling on the appeal.
