to his ex and there is a possibility that I am pregnant (1 week late). Can he go to the courts and stop paying his ex, or does he have to wait until the baby is born? I know a child is one thing that will stop one from having to pay alimony, along with marriage, ect... (and no this pregnancy was not planned as a way for him to stop paying.) but I am not sure if he can go to the courts with the baby still in the womb, or if he has to wait for the birth as proof.

okay, some people need to read BEFORE they answer. He has no other kids with his ex or anyone else.. thats child support. ALIMONY is paying the spouse for other reasons other than children. And no he is not trying to get out of anything. The car that he was paying her alimony for is completely paid off. I would say there is A LOT of judgement coming from some jaded people. To those of you who just answered the question without judgment, I thank you and appreciate your input.

He has to wait until he can prove that he is the father before he goes to the court and ask them to amend he payments so that he can afford his new child as well as live him self.

You are mistaken. The fact that you're about to have his baby (or marry him) does NOT mean that he will stop paying alimony. He can ask the courts to adjust his payment because his circumstances have changed and they may decrease the amount, but that's not a given. And, yes, you have to wait until the baby is born. Even then, the courts could request that he proves that your baby is changing his life - such as wanting documentation proving the two of you live together and that he has a "vested interest" in your child. There are no simple fixes!

Just because you might be pregnant does not get him out of his obligations to previous spouses. If that were the case, then every JOE BLOW would go out and get their new chick pregnant to get out of the support. I do not know what state you live in, but I can't imagine any law saying that once a guy is divorced and fathers another child, he is off the hook for the previous commitments.

He has to pay child support to the ex no matter what until that child is 18 yrs old. He may be able to get it lowered (but I doubt it). Things just got worse for you bf if you are pregnant. Use protection if it turns out you are not.

I'm not sure where you get your information, but him getting another woman pregnant, or marrying her has nothing to do with his alimony. If his EX gets married or pregnant, then it stops, but he is obligated to pay for however long the courts say he is obligated to pay. Whatever else he does is up to him, but it has no effect on his obligation to pay his ex wife.

He doesn't have to stop paying it unless his wife or exwife is pregnant to someone else or if she gets remarried. The courts do not care if you are pregnant. You have nothing to do with their situation.

your nasty obviously you new that your partner already had children so what just because your pregenant now he has to stop paying for the children that he wanted,think about it "WHAT IF HE LEAVES YOU". no courts girl will eva stop a man for paying for the children that they wanted and so they shouldnt,you are so selfish
