Not if you haven't already filed for child support. The court won't let you ask for his money when it becomes available now that he actually has money to give you. Because then child support becomes a hand out rather than your former husband supporting his children. The court will most likely dismiss your request if you're filing now that he is getting married and will have money with his wife's income.

If it were that easy, everyone would be doing it.

What you have to ask yourself, is why you want child support from his new wife's income? Is it because you need the help, or are you upset because he is re-marrying? I believe that every 3 yrs. the Attorney General decides to update your case, and when that happens, you can request to have is income evaluated, and see if you are entitled to more, but doing it right now may cause problems on all ends, and unless you absolutely need the help, I would wait a while before you do anything. At least he is currently paying child support, which is more than can be said for alot of men. I hope this answers your question, and I hope that you really consider what this will do to your kid(s) if not handled properly.

Its hard to explain but in most states once you are married your income is household! So when you request child support the court will ask what the household income is this will include the wives! I don't think you are greedy! When she married your ex she knew your child would become her stepchild and she would also help support the child! If child support has already been arranged you would have to wait to see if he misses payments then when court comes around again you can make the court aware that the household income has changed.

Actually, you can. It sounds crazy (and unfair), but child support is based on your husbands' income. When the household income increases, you can request a higher child support payment. Unless you are barely making ends meet and have been unfairly shouldering most of the cost of the child's needs, to essentially take money from an innocent third party is pretty selfish. You don't want that karma.

Actually you can have her wages included now. The reason why i know this is my mother is having it done to my father and his wife. If your ex husband is anything like my father(who is a deadbeat dad) then i see no problem with it. Im a 23 year old woman and i have 2 younger siblings. My father makes no attempt to contact us or be there for us for the simply fact that his new wife does not like my 15 year old brother. Also my cousin who married a man with a child from a previous relationship was responible for the child support too. These other women may call you a gold digger or greedy but they dont know what your total situation is. Take care of your children/child and do what you think is right for you.

You can't, in most states. Speak to your lawyer....but in the majority of US states, his new wife's income is completely seperate from his. You did not divorce her, you divorced him....she is not legally responsible to provide monetary support for children from his previous marriage. She has no biological ties to the kids, therefore does not have any responsibility to pay for them.

If your Ex husband has gotten a raise, you can refile for an increase in support based on his new income...but her income will not be counted in almost all cases.

This is a state by state issue. Anyone who tries to answer this question without knowing which state you live in might probably be wrong. You need a lawyer to answer this or google your state name and other keywords like "child support" and income.

While you aren't really saying why you want it, in some states yes you can petition for that. However you could just as easily end up getting your support reduced because he now has an additional financial burden placed on him especially if they have or plan on having any more kids.
