Are there specific boxes that must be purchased for certain states/vicinities?

It's legal as long as the seller legally owns the box, however you may wish to contact your cable provider for the details on your second part of your question. It's likely that you would have to purchase a box that was previously used with the same cable company as they may need to have a record of the serial number in order to authorize channels on the box.

This is not different than buying a TV with a CableCard slot.
You don't need to rent the box, but you still need to get a Cablecard from your local cable provider (at a smaller fee).

Having a box does not give you free cable.
