My foreign friend got in a little bit of trouble during a visit 7 years ago and was denied entry at JFK 5 years after. The lawyer who handled his case back then claimed he was charged for misdemeanor and that it doesn't construct basis for rejection at any port. Does anyone have any idea whether this lawyer is telling the truth?

This should hold up.(what the lawyer says) If not then the charge is actually not a misdemeanor. Sometimes plea bargains illegally stick the higher charge right next to the lower one stating "not charged" in fine print. In this way it can look bad.

This way often what you thought was a misdemeanor charge can haunt you because the people look at the other higher level charge as if it were legally on your record.

If the misdemeanor was for narcotics, prostitution, assault, or another crime "involving moral turpitude" your friend can be denied admission to the US.

Check the crime charged, conviction (felony or misdemeanor), and contact the lawyer...

You are listening to a lawyer tell you that the US doesn't have the right to deny entry into the US, that's a big joke. What can your friend do, he isn't a citizen you don't have any right as far as contesting this.

Sweetheart nobody has never been stop at the airport for misdemeanor charges, so you better check that tricky lawyer, now if it was a felony, you know he ain't coming back in here. so check it out.

Of course not, Bush plans to welcome the drug dealers, criminals, and gang members. If your friend is Mexican, he should be just fine.
