just asking cause i got photoshop

Yes, it is theft of intellectual property.

In the U.S. ALL photographs are considered copyrighted by the taker (or the employer/person or organization paying for it in some circumstances).

I am not a lawyer, but my research on this says there are both civil and criminal penalties for people found guilty of doing this. If the holder has REGISTERED the copyright they usually have the right to sue you for the cost of the photo, punitive damages and legal fees for the cost of recovering there intellectual rights.

As everyone has stated, the short answer to this is YES.

There are a very few exceptions, one being if you were to manipulate it drstically enough that it is no longer a derivative work, but is now different enough to be considered a new work. Even if it fits that requirement, you must credit the original work, and you definately should ask permission from the original artist, or copyright holder first.

The best rule is to assume everything is copyrighted, and not to be used in any way without getting permission.

This is called making a derivative work, and it is copyright infringement.

Also, there are numerous court decisions saying that doing what was suggested above (shooting the same photo yourself) is copyright infringement. Your photo has to be different enough to show significant creative input from you, not just a reshoot of someone else's photo.

It is stealing if you take the photo and edit it and call it your own photograph, if you edit it and do noticeable photo manipulation to it and credit the original photographer, and list it as the photo manipulation is what you did, it should not legally be considered stealing.

Yes. Theft plain and simple.

Having photoshop does not give you legal permission to alter anyone else's work.

Use your own photographs.

yes, as long as the image has a copyright..

but..

u can use images from stock photo website,. My favourite is ww.sxc.hu cuz its free, and u can use the photo anywhere u want.. there are only few restriction...

are you making money off of it? then it's a crime.
Just say the mod is yours. You can take ownership of what you did to the photo, but don't try to convince someone that you were the photographer.
