I subleased an apartment from a girl, and paid all the 3 month rent to her in advance. She said she would pay this rent to the landlord directly.But one month later, I received a notice that this girl did not pay the rent and the landlord wants to evict her and she was summoned to be in the court. I feel worried that I would be evicted from apartment . so what should I do? Thank you

This apartment do not allow sublease, so both of us wrote a short agreement about the lengh and money I paid for subleasing this aparment. And I paid on check. I am wondering how badly it would affect her if she did not pay the rent and was summoned to be in court?and what should I do if I want to sue her in small claims court? Thank you very much!

Provide proof to the landlord that you paid (canceled check, money order receipt etc). If you paid in cash and have no proof then you are probably SOL. If you do have proof then the landlord and you can sue her in small claims court.

Lots of Landlords have rules that you can't sublease an apartment. If she is out you are out. Stay with a relative or close friend for a while. Make sure you are the sole tenant next time not in a sublease.

1st go talk to the manager. most apartments do not allow you to sublet. If they do not allow it, you have nothing to stand on.
If they do, be prepared to show proof of the rent you paid the other person. The good news is that the other person is the one getting evicted, not you, because you are not on the lease, so it will not affect your credit. :)

did you get a receipt from the girl to prove that you pay three months in advance. if not you have no prove and you may be asked to move out unless you can pay back rent to the landlord.

always claim and get a receipt and um maybe spend a day looking for other apartments

Sorry, but if you are not on the lease you will probably have to move..looks like the girl robed you....
