Hi,

In New Jersey state.
My friend drunk too much and assualted a police officer. He says he pushed him. He is now out in bail. What will be his sentence ? Will he go to jail ? Any possibilties for probation or fine ?

Charges on him:
Simple assault on Police officer
Resisting Arrest

Its reported as he pushed the officer and tried to punch him on face.

Amazing how "stupid" people can get when under the influence of alcohol or drugs.

In New Jersey a simple assault on a law enforcement officer is charged as an aggravated assault and is a crime of the fourth degree if the victim suffers no bodily injury. A crime of the fourth degree is punishable up to a year in jail. As far as what will he get, it all depends on the judge. Most judges don't like it when people assault or threaten to assault or attempt to assault law enforcement.

Hello Craig, In English law "assault" is frightening someone into believing they may be hit. Do not drink alcohol if it leads you to become violent. Police officers are only doing their job. You should seek legal advice as soon as possible. Robert.

In the UK you just don't hit a police man,to do so you will most certainly find your self incarcerated for six months or more

(5)Commits a simple assault as defined in subsection a. (1), (2) or (3) of this section upon:

(a)Any law enforcement officer acting in the performance of his duties while in uniform or exhibiting evidence of his authority or because of his status as a law enforcement officer

Simple assault is a disorderly persons offense unless committed in a fight or scuffle entered into by mutual consent, in which case it is a petty disorderly persons offense.

Most likely probation. Next time, he should be so drunk that he starts to defy authority like that.

"simple assault" on a police officer doesn't exist. Your friend should be punished to the fullest extent of the law.

I doubt he does time. I don't doubt that the cop got rough with him first but that doesn't matter. Judges believe cops.
