Indian law claims to be equal towards all, but as far women's laws are concerned, it seems to side the self-made prostitutes who entice away wealthy husbands, leaving the families of these husbands almost on the roads... See; http://groups.yahoo.com/group/destroyadultary
Also it gives lots of facilities to females to trap their innocent husbands by misuse of IPC 498A... See discussions in http://groups.yahoo.com/group/indianjustice
Also, when NCW and law ministry was requested to amend IPC 497 & 498 by changing the words husband and wife to spouse, may be some authorities got frightened of being alleged themselves or so... who knows... and applied that IPC 497 & 498 should not be criminal laws at all!
Do you think in this senario;
An Indian woman, a legal wife or daughter, will ever get justice?
Or Only self made prostitute will keep getting indirect shield of the laws that do not give chance to the wives to proscecute these self made prostitutes who entice away their husbands?

In practice women in India have a very low status, even those with education and wealth. If their husbands want to throw acid in their faces, for example, it is OK. The men will be arrested if the woman is from the upper classes; however no charges ever stick and the men are soon released. So in your situation you have no chance at justice for such a 'minor' crime. YOU WILL NOT HAVE JUSTICE in India. Cut your losses and get as much money as possible to help you get back on your feet after your divorce.

Hey Dr., you're asking this on a site that primarily involves US laws.

IMHO, you seem to be taking the wrong tack on this whole issue. It appears to me from your tone that you feel the "self made prostitute" is somehow responsible for the fact that the husband can't keep his d*ck in his pants where it belongs........that's not the prostitute's fault, she's trying to make a living. Prostitution = sex for money in the US.

You claim that these "self made prostitutes" entice away husbands from their families and obligations. So then am I to assume that men in India have no free will and are guided according to basic animal lust, and lack the moral compass to know that their actions are wrong. Are men in India to be likened to uncivilized savages? Unable to control carnal urges?

The husband in this scenario appears to be the offender and violated his marriage vows. What is the normal sentence for this offense in India?

(BTW, this female thanks God she's living in the US of A)

Certainly, there are courts of justice, who will look at petitions regarding 'alienation of affections' as actionable! The specific remedies and procedure to put up the case, have to be confirmed from legal experts, but certainly remedies are available, and justice can be enforced!
