I had an accident in Houston, TX, and the illegal immigrant who hit me had no license or insurance. The cop said that he could not arrest him. I got screwed out of paying $3000 in damages for my car because I have only limited liability, which covers other drivers hit by me. What legal action can I take againt the illegal? what are my next steps now? Can I put a lien on his car?

I'm not sure what the cop meant by not arresting him. 1) he's illegal and 2) he's driving the streets of Texas without proper insurance. That atleast give the cop the ok to impound the car to get the jacka** off the road.
Hopefully you have uninsured motorists property damage coverage on your policy...pull it out and read your dec page. If you have it it will be listed right there, most likely with a $3500 limit. If you're still not sure, call your agent to find out....if you have the coverage submit the claim for reimbursement.
Chances are the guy has fled town or his buddies/family are going to hide him out. Don't waste your time suing him because you most likely won't find him, and even if you do...what does he care? He'll just go back to wherever he came from and return later, and he certainly won't pay you.

This happens all the time here in Phoenix. Unfortunately, there's not much you can do. The illegal immigrant is probably already back in Mexico. This is why you should carry uninsured motorist coverage on your vehicle. It's required by law here. I wonder why the officer wouldn't arrest the man? Maybe those aren't serious enough offenses in Texas? That's what they do here so they can't skip the country. You can sue him in small claims or civil court, but he probably has no assets and it wouldn't be worth your time, that's if they can find him to serve him the summons.

My fiances jeep was totaled recently by an illegal who was speeding and had been drinking. The illegal fled on foot was never caught and the truck he was driving was stolen. They know he was drinking because of the open partially full beer cans. The cops told him that there is NOTHING he can do especially since there is no way to tell who the person who hit him was. Luckily my fiance had full coverage insurance. He got another jeep.

Dude, the only viable thing you can possibly do is help 'drain the swamp' in Washington DC in '08. Our elected officials (both parties) have completely abandoned the American public in their never ending quest for political power and voter base. You cannot sue the illegal because he will never show up for court. You can't put a lein on his assets because he doesn't have any. Our only defense in times like these is to insure ourselves.

Still only payed for half of the damage to my car... illegal bastards. :)

what good will that do? he didn't have the $ for insurance and his car was wrecked in the accident. you will never see any $ out of this and it will cost you filing fees.

the police lied to you..........the law states......all must have at least liability insurance.......the policeman should have arrested the person.....he broke the law.....three time,s....no license,no insurance, & he was here illegally!......see a lawyer...if you can,t find the illegal person to sue him.....you may be able to sue the police!.....for aiding&abeding!.....not to mention lying to the public.....the very people their suposed to protect!.....good luck! .........just looking at the other answer,s.......why should we...the public...pay extra mony for uninsured motorist......when the law states ALL driver,s must carry at least liability insurance......the illegal alien broke the law & should be punished accordingly!

If he is an illegal and has no insurance and even if you can prove him to be at fault in small claims court. You have no chance of collecting any monies from him.
Do not spend money on a lawyer...... sorry this happened to you. ..........................hang in there ;)

Get a lawyer and sue if you have the cash for it. Make that F-er pay for sneaking into our country. If you don't have the means to sue then unfortunately you are SOL. Unless you have "Uninsured Motorists Property Damage" coverage on your policy then you have nowhere to go for payment.
Also, for the future, think about rallying your pals to send letters & emails to your congressman (both state and federal) to get tough on illegals so next time, the cop CAN arrest him/her.
