A friend of mine her daughter the mother of her 3 year old has recently died. The child wanted to stay with his grandmother after this tragic accident. Now the father wants to move the child up to N. CA. How can the grandma make sure she will still be able to see the child?

She has no rights unless the court gives them to her, but she certainly can petition the court for visitation. Of course, she should talk to Dad about it first and see if they can work out an agreement between them (it's always better to do that when possible instead of taking it to court).

Here's a link to the CA code that addresses grandparent visitation:

Grandparents do no longer relatively have rights until the grandchildren's mothers and dads are divorced and their son or daughter is in detention center. if so, they have the remarkable for visitation, in the event that they take the case to court (or if the grandchild is authorised to bypass to with the aid of the different be certain). i do no longer understand what you advise with the aid of "disobey the mothers and dads".... do you advise, the grandparents might enable the infants not sleep slightly later, or supply them candy, etc? if so, grandparents do loosen the reins for their grandkids many cases... it is not odd. i do no longer think of maximum grandparents advise any harm with the aid of spoiling the infants slightly. take care.

The judge would have to grant visitation rights for the grandmother as well.
