i moved to texas with consent of my sons father, he signed a document that allowed this now he says hes coming over and taking him, can he do this? he doesnt call him, or support him in any way, my son is 4 and doesnt want to g with him what can i do?

hes always been a prick ive been gone for 6 months n he hasnt visited cause he was on prbation his probation ends tmorrow 6/20/07 and hes coming from the bay area california to el paso to try and take him

you did the right thing by having him sign a document saying that this was okay. make sure you keep that document because it will be a huge determining factor in your court case. since you say this Dad does nothing for his son then the chances of him paying money for court to fight you in a custody battle is not likely and even if he did follow through on going to court it definitely wont go his way to have full custody. so dont let this bother you. everything is more in your favor.

no, he can not do this. keep all your documents handy just in case but, he sounds like he's trying to scare you. has he always been an *sshole?
EDIT-notify the local police of his threat. there's nothing they can do about a phone threat but, it'll be on record.
i'd love to say he won't do anything but, the truth is, you don't know. i don't mean to scare you. really. keep your son close. make sure all the people who care for him ,i.e. school,daycare,babysitters, know of this threat. you can't be to safe. especially if he's that much of a prick. take care.

When its joint custody you would have to give your consent for your son to move out of state with his father.
