I put a down payment on a 2003 Jeep Liberty, but the title did not clear on the car and they offered me a 2005 Jeep Liberty instead. However, now I have found a better car that I want to put my $1500 deposit on at another dealer. I was given a receipt for a deposit on a 2003 Jeep Liberty, and they have just cashed the check yesterday... can I get my deposit back? The salesman said I would get my deposit back if the 2003 Jeep title did not clear in a week, and there is nothing that says the deposit is non-refundable in the receipt. I did not sign any paperwork.

Yes, you can get your deposit back. It was on a vehicle that they cannot deliver, so it doesn't have to state that it's refundable, that would only apply if you were trying to back out of the deal.

If they don't give it back to you pronto - tell them you will report them to the DMV in your state, and do it if neccesary. Unless they're a shady dealer, I doubt it will come to that.

Yes you can get your deposit back. They have no reason to keep it if they can't even deliver the car you negotiated for. In the future though, don't leave so big of a deposit. 1500 is a lot to hold a car. You should be able to leave as little as 50 or 100. By charging a big deposit, they are hoping to remove you from the car market. Since they have your money, you are unlikely to go look elsewhere. At least that's what they figured.

You have been scamed!!!! It is called "Bait and switch" and any contract in the 50 US States says you can back outof a contract with a licensed Dealer within 3 working days. Now if it is a private individual take them to small claims court and get back all plus another half for "cheating you"

Absolutly, They have to give you the deposit back,and do not take no for an answer.You will win hands down in court.They did not make good on thier part of the contract,but don't wait to long,and be honest with them,tell them you found another car,you like.

You should be able to get it back as the deposit was for a vehicle that the dealership couldn't come through with.

It sounds like you should be able too get it back. Approach the dealership, and request it politely. If they refuse to return it, contact your local Bar Association, and get the name of an attorney specializing in these matters. Make no threats, and do not do anything disruptive at the dealership.

If it was the dealers fault then yes you can they broke there own contract if you have any problem get your lawyer involved,. hope this helps
