Notaries cannot legally marry someone (unless they happen to also be ordained). A Notary just confirms that it's your signature on a document.

I can answer this question from personal experience. I contacted my bank to see if the notary services included marriage licenses and I was told "Yes". My hubby and I went into the branch with our license and were told that the notary had to be specially trained to perform ceremonies to notarize the marriage license. Needless to say, I contacted the source at the main customer service phone line, while at the branch and after a few minutes of research, he concluded that he had given the wrong answer. I live in the State of Florida. Make sure that the bank official can notarize the license before you go.

I do not know about other states. But I am a Notary Public in the State of Texas, and conducting a marriage ceremony is not something I am permitted to do.
I can, however, notarize your petition for a divorce.

If he wants to marry you then yes you can get married. If he doesn't want to, you shouldn't force him into marriage.
If you're asking can you be married BY a notary than yes but only in the states listed above.

No but some states will allow that person to get ordained on the internet in a day or two and perform the ceremony.
Some states don't allow the officant to be internet ordained so call the Justice of the Peace's office and check the laws where you are.
