My child's father owes back child support and they are taking it out of his taxes. I didnt have any problems last year, but this year I havent recieved anything so I dont think he filed. How do I know and what can I do about it?

Contact your Child Support Enforcement rep (sounds as if you already have one) and see if they can collect or take him back to court. They have the ability to check with the IRS and get a lot more info than you can from that agency about HIS returns or lack thereof. They also can get a contempt order faster than you can most likely. If he has a job where he is not self-employed they can also get a garnishment of wages...if he stays in one job long enough! You can't. The IRS treats all tax returns as confidential. No local judge or child enforcement unit can force the IRS to divulge any information to any third party without the consent of the taxpayer.

Some taxpayers who have had a refund offset in the past have changed their withholding amounts so that they get little or no refund when they file. As long as they owe less than $1,000 at tax time, there are no penalties assessed by the IRS. This is all quite legal (as far as the IRS and the Tax Code are concerned anyway) and there's nothing that you can do about it. Sorry.

About the only thing that you can do is contact the child support enforcement unit and see if there are any other ways -- wage garnishments, etc. -- to get the support that your kids are due.

if you haven't received anything, you need to go back to family court [or whatever it is called in your state] and ask the judge to hold him in contempt.

Only the judge can issue an order to his/her enforcement division to discover if IRS has seized funds from his tax refund -- you can't do that as the IRS holds that information is confidential.

You can't find out. If you don't get anything, it doesn't mean that he didn't file - maybe he just adjusted his withholding so he didn't have a refund coming for them to take.

you can contact either the d a office and have them check which is the smarter move or you can go to irs.gov and check out there on line site or go to nearest irs office with his s s n and have them run it. the problem you will run into is the privacy act. so your best bet would be the d a , or perhaps a judge who did your custody case
