I helped my fiance, now husband, file his taxes so I know he filed divorced. He has been divorced for over two years. For some reason, when he received his refund check, her name is on it too.

Sorry, he filed as single, not divorced.

He needs to go to IRS.gov and look for the proper form to request a change to his filing status.

If you can't figure out the form then I would submit a request in writing.

Also you can call your local branch to have them look into the matter though that will more than likely take the longest time to get corrected.

The only accurate way that her name would be on the refund check is if they had filed a joint return. Since you say that you are sure they didn't, he needs to contact the IRS and ask them what's going on since there is obviously some kind of mistake.

By the way, tax returns aren't filed as "divorced" - you're married, single or head of household. How did he really file? Was her name on his return? Where?

If both names are on the check, it means that they filed a joint reuturn. That would be illegal if they were not married as of 12.31 of the year that the return was filed for.

Keep in mind that this could be for a tax year when they were married. A late-filed return or an amendment could result in a check with both names on it and would be legal and proper if they were married as of 12.31 of the tax year in question.

BTW, there is no such filing status as "divorced" so he could not have filed that way. Someone may be blowing smoke here -- you, him, or the ex. Just not sure who...

Double check the return. Make sure it was filed as "single". He should contact the IRS and not attempt to cash this check. Depending on when his divorce decree was final the ex may be entitled to some of this money. She may still be filing as married.

look the forms over...if he IS divorced AND filed as single...its a irs mistake... get it fixed...dont tell ex wife and dont try to cash it.
