and can it be considered rape if u have sex with sumone 2 yrs. younger...or 1 yr. younger??
im just wonderin cuz i saw a show about how a guy went to jail cus he was too old to have sex with sum girl..it was weird..

Be really careful about that! The law doesn't play games about this sort of thing and if you get in that kind of trouble, it will be worse than you can ever imagine. Don't take chances!

In the United States, "Statutory Rape" is the charge you are looking for. If you happen to be over the age of consent and your 'girl friend' is under the age, even if it is by one day, then the girls parents can charge you with Statutory Rape. This is rape with a slight difference. According to the law you are having sex with someone who is unable to consent, due to her age. In the eyes of the law, this is the same as having sex with someone who does not consent and is your age. Both are rape charges and so, yes, you can go to jail and prison.
If you are questioning if they charge this very often, the answer is no, but then they seldom write tickets for people who go only 5 miles over the speed limit. I might not mind the ticket, but I sure as heck would not want to do the prison time!
So, if the thought is should you do so or not, I would recommend that you wait. It is a lot safer!

I did read a case like that in Georgia,this 17 year old football star went to jail for having oral sex with his 15 year old girls friend and now he is 21 and still in jail,last week a judge dismissed it and called it consentual sex but before he was released the prosecute got a child molesting charge,he is still in .they said if he just had sex it would have been OK because of a Romeo law in that state but they don't have laws about allowing consentual oral sex so he is staying and appealing.depends on your state I guess...and if you touched one of my daughters!

u shouldnt be having sex if ur under 18. If u are 18 or over u shouldnt be having sex with anyone under 18. U will be put in jail, then everyone will have sex with u!

if one of them is a minor (under 18) and the other is over 18, then yes, that is illegal. but if they're the same age, then no. the parents and the girl or guy can put a restraing order on you tho. it's not rape if both of them agree to do it. if one of them assults the other or makes them do it by force, then yes, that's rape.

in aus you cant, you can get charged if you have sex with someone that is under the age of 16 but they all so have to be to years younger than you

It depends on the age. If the girl is a minor, you could be accused of statutory rape.

If both people involved were of legal age, and consent was given from both of them, then there really shouldn't be a problem.
