My best friend is residing in Texas and will be until her probation is completed 3 years from now. She has an F2 felony and has done nothing to ever get in trouble or violate it in any way on purpose. Never has she skipped out on checking in, never has she dropped a dirty urine, never has she gotting in any type or trouble or even corresponds with anyone that is on probation. She does her community service every free chance she gets and is down to 9 days left. But the other day coming home from work, she got a speeding ticket. I was wondering how likely it is that they could revoke her probation and sentance her the full sentance in prison? Now don't bother to respond if you have a smart *** answer like i read on one response to someone else about thanks for wasting my tax money. That was extremely childish. But to those of you who take the time to answer the actual question many thanks in advance.

Oh also she has all of her fines paid and will have the ticket paid when its due.

As former Probation Officer and current Police Officer in Texas, I can tell you your friend has little to worry about. She could, technically, be revoked for something as minor as a traffic violation, but it would never happen; provided there is no other violation pending, behind on payments, community service hours, or required classes, etc.

She needs to inform her P.O. immediately. Depending on where she is, probation officers and police officers run in the same circles, and she does not want her P.O. to hear about the stop from the officer. But even then, she might get nothing more than a stern talking to. I never worked with a court that would entertain a revocation warrant request (or even a modification) for a traffic ticket. If she tells the officer about the ticket, it might serve her well if the discussion of an early termination of probation comes up in the future.

From what I have seen they don't follow any set rules. If the probation officer is a decent person he/she may check into the ticket situation and let it slide, then again he/she may go for the power/god trip.
It seems like different offices have different guidelines or goals
She needs to tell the probation officer immediately if for nothing more than the appearance of trying to do right . they frown upon finding out about it through the grapevine.
She needs to fight the ticket at all cost as this looks better for her in the probation court as no conviction. no conviction no violation.

seriously, it takes aprox 3 months to file a probation violation from start to active warrant, unless they put a rush on it. AND most judges won't even look at a motion to revoke unless the defendant has at least 3 major violations. if she hasn't had a single violation in her 3 years and is that close to being done, the chances of her getting violated are slim to none. even if she did, she has 9 freaking days left on her sentence. jail time might be a day or two at best.
the best thing your friend can do is to tell her probation officer before the PO finds out.
also: and this is a biggie because the laws changed in 2005 reguarding fine/court costs. tell your friend to check with her PO to make sure she has paid all fines, court costs, appointed attorney fees, probation fees, crime victims fee, crime stoppers fee, UA fees, etc NOW. they can now keep her on probation until all the fine/court costs have been paid.

Being as we are talking about Texas here, I understand your concern. From my experience, I wouldn't lose sleep over it. Chances are they'll never know it happened. The average probation officer is loaded with fifty or more people on his/her case load at any one time. In addition, there are plenty of others on probabtion who will play the odds and end up getting arrested for a new possession, DWI or similar. The important thing is not go to jail. A ticket can be overlooked, with a possible stern talking to if the officer does find out.

Many on probation in Texas, as I said, do not live it down. We often describe probation as having one foot in and one foot out of jail. Still, as long as she didn't go to jail she stands a high chance of getting by with this one. Besides, the jails here are so crowded inmates are sleeping on the floors for lack of beds. The Prison system is not much better for that.

You can't get revoked for a ticket, but my advise to her is to leave Texas and move up north as soon as she is done with probation; Texas is very unforgiving, trust me I know.

Tell her PO. She has nothing to worry about. Yes they could revoke her, but they will not on something that minor.
