can i get sole custody if the father dont see his son much like he should with in the 10 months he seen his son 8 times

Are you trying to get no visitation or just sole custody? It sounds to me as if the father only has visitation at this time. If he had joint custody then he would more than likely have the child half of the time.

You would probably have a good chance at sole custody but why would you want to stop any visitation? As long as the child is not being harmed there should be some type of relationship between father and son.

You probably could get sole custody of your son but if the father isn't harming your child and I'm sure you would like him to see your son, why take away the little bits your son actually gets to see his daddy.
If you're thinking that taking away all the father's rights will make him wake up, I really don't think it will, you'd just be hurting your son.
If the child's father isn't harming your child then I see no reason to not allow him to see his son, even if it is only a few times a year.

If it has been court ordered that he has to see him and doesn't it would be better for you to get sole custody..If not if you can prove that it is an unhealthy relationship(him seeing your son when he wants) then that would really work in your favor.
