unfortunately, when a car accident happens involving a car making a left turn, that car is found to be at fault 99% of the time for failing to yeild the right of way to oncoming traffic. the only times that i've seen that to be not the case is when there are independent witnesses confirming that the other driver going straight blatantly ran a red light.
if you don't have independent witnesses confirming that the other car blatantly ran a red light, i'm sorry to say that you would likely be found at fault in the eyes of the law and the insurance company's liability investigation.

Other drivers in the area who were witnesses can be critical, also if there are any video cameras in stores pointing in direction of intersection.
You see by the time the police arrive, they did not see the accident, so it is what you say, and what the other driver says. How are they to know which of the two of you are being truthful?
There is also possibility of malfunction in the lights.
How do you know they ran the red light when you were turning left in front of them ... sometimes the green turn signals are not in sync for people coming in opposite directions.
You need to stand on corner where you can view lights opposite to each other to be sure what the normal light cycle is.
Be thankful that you are still in the land of the living.
Hopefully your insurance rates won't go up astronomically.

I think the law says something like, "The guilty party is the one who last had the opportunity to avoid the accident and failed to do so". If the other driver ran a red light, chances are you may have left too early, since the light may have just been changing. That's the only way I believe it could be your fault. Sounds like you need a good lawyer. Good luck!

The only thing that makes sense is that even if you had the green light at the moment that in itself doen't give you the right the drive in front of oncoming traffic when you now it will cause an accident. The green light tells you GO but it is your responsibility to do it the safest way possible. Think.

im assuming the other party is stating they had a green light.. they may have a witness as well that agrees with them. If you both had green lights.. you have to yield the right of way to them. Therefore- your at fault.
How on earht do you know they had a red light anyways? Did you just have a green light (and not a green arrow) if you just had a green light.. you ALWAYS have to make sure to yield to traffic to the opposite direction... b/c.. if your facing them.. how do you know what light they have?
GREEN LIGHTS ALWAYS YIELD WHEN TURNING LEFT. I cant say it enough.. how on earth would you know they had a red light if you were facing them?

Im guessing its because you failed to yield. You cant assume somebody is going to stop. Sure he ran a red light but you still failed to yield. Most intersections now have video attached to them. Have your attorney fight it in court.
But the basic point is you failed to yield, didnt matter the other person broke the law. You will have to prove that. Get the video. If there isnt one its your word against theirs you will lose everytime.

I am confused, if they ran a red light it is absolutely their fault. BUT, if they turned right on a red and you impeded a turning action that was in motion, it would be your fault. More details would help.
