It's not legal to smoke in ANY business establishment in California. Just call the police. They will cite anyone smoking in a business in CA.

No. Some bars allow it anyway and may have deals with the police or have it so that everyone turns a blind eye to it.
I would ask the bartender/owner to tell the person to go outside and if it's one of those places where they allow it, I would find somewhere else to drink, because I doubt they will care about your desire for clean and fresh air.

the laws for smoking bans in CA are in place for the employees of the bar, not the customers. what this means is that if ALL the employees agree that it is ok to smoke in the bar, then it's ok. since this is true, what happens is that bar owners that want a "smoking" bar won't hire anyone that's not ok with it.
so really, there's nothing you can do about it unless you're working there. otherwise, youll just have to go to another bar!
sorry man. it's pretty nasty, but that's why i don't go to the bar right around the corner from me.
