I am a recovering alcoholic and did mention I was not drinking prior to ordering food and drinks with associates during a business trip dinner outing, when my drink was spiked by a colleage.

yes you can. any time someone slips someone something without their knowledge it is a felony, and they will be in all sorts of trouble.

I don't think that suing someone is the best way to go. People seem to use it as an quick fix. If you know who the co-worker was, go speak to him/her and tell them your feelings about your drink being spiked and it interfering with your recovery. You might also discuss compensation or offer suggestions on "punishment" for the co-worker. It might also be wise to have a supervisor in the meeting as well, so they might have an idea of what is going on and can help with the situation as well.

Suing takes a lot of money and energy. I think that would be a bad way to approach it. Let your colleague know he is a jackass for doing that when you are trying to recover for alcoholism. Maybe tell your boss and get him fired, after all it was a business trip.

If it was a business trip, you could probably sue whichever business that person represents.

I don't really think you can sue an individual. I mean, you can, but usually they don't have a whole lot of money, and that's usually the motive of a civil suit.

You can only sue if it caused you to go into a relapse. Then you could go after them for damages. Otherwise just let it go. Do you know if they intentionall pulled out a flask in an attempt to sabotage you? If you mentioned that you weren't drinking only in passing, perhaps they misheard you and forgot to order your drink as virgin.

This is a very unfunny 'joke' for someone to pull.
You may have a difficult time proving who did it.
But if you afford a lawyer, go for it, to scare them.
Otherwise try something like the Judge Judy show.

I find what he did very disrespectful. Perhaps suing is a bit extreme, but why don't you talk to a lawyer. People should take this kind of thing more seriously.

You can sue anybody you want, but will you win? You will, if you can prove two things: the person who did it knew the consequences and you suffered damage.

No. It will be thrown out as frivolous. Drag the person to an AA meeting and talk to him about how he upset you.
