Our tenant's lease is up around July 23rd and in the lease it states we need 60 days notice of his intention. Throughout the year, he has been difficult to get a hold of via email and phone and quit his job and got a different cell and email without ever notifying us. It took many, many phone calls, emails and a written letter to finally get the information and when we asked for notice by the 15th of June (this past Fri) of his intention, he still never let us know. We called him all weekend and no answer (despite phone messages). He said he would let us know by Friday if he was staying another year or not. He also has been late with rent more than once. So...we told him, in advance, that we were advertising for a new tenant and have received inquiries. And, if we didn't hear from him by 6pm today, we were renting it to someone else. He never called. Is it rude to let him know that we are not renewing his lease? He's not a bad guy but totally unreliable and disrespectful.

EVERYTHING has to be placed in writing to hold up in a court of law..as well as write him a letter to inform him that his lease is up.. And it has been decided that you will not be renewing the lease..I do not know what state you live in.. laws are different from state to state.. But one thing in all states that will hold up is the written words.. Letters.. You can have it sent and have him sign for it or hire your self someone that will deliver the letter and have it documented that it was delivered to the proper location.. He is a nightmare and it will only get worse...
Not paying rent on time is good enough for eviction..

Right now you are not doing an eviction, yo are just doing what it says you will in the lease.

Send him a letter stating "As we have not heard from you since the deadline, we have decided to not renew the lease. Please remeber, it is your obligation to vacate the apartment by no later than such and such date. Should you fail to do so, that will force us to take eviction action against you, which may result in you having to pay legal fees and will make it difficut to rent a new apartment with a black mark on your credit record. "

Hopefully, he will just pack his kit and go. If he doesn't then yo u will have to go through the evictions BS. Get a lawyer.

Ive been a landlord for 4 years and it stinks. 25% of your tenants are great. 75% are scumbags.. Always get a security deposit, never give them a break if they are "a little late." Get rid of them and give a home to decent renters.

Don't waste you r time on dirtbags.

you may want to look into your rights as a landlord, but don't you have to give a 30 eviction notice? If you have to give 30 days for eviction it sounds like you may need to give as much or even more of a notice for not renewing a lease.

Check with an attorney. Don't leave yourself open to a lawsuit. Certified mail may be the way to go. Is he taking care of the place? Is there a penalty for late payment. You may replace him with someone who won't pay rent and requires an expensive eviction.

Your not him mommy, your his landlord. If you know you can get a better tenant, get one. Less stress is always best.
Don't look back, you did nothing wrong.
