If you file a legal motion, appealing to the court that you want your mother to be granted SOLE custody of the child, that can be done. Joint custody will still provide that your husband can take the daughter at any time and go anywhere. You should consult a good attorney before making any final decisions

First, there can be no joint custody while your in any sort of basic or advanced training, I am quoting Army Regulation 601-210, in addition, you can not give custody up for the sole purpose of joining the military although you did not hear that from me. You can do 1 of 3 things, give the x full custody, get your mom full custody or don't join. Sorry to be the berarer of bad news just stating facts. By the way everyone else whom previously answered this is wrong.

Who is the "he" you're referring to? Is it your husband or the man you had a relationship with? I'm guessing it's your daughter's father. Why would your joining the Army allow him to have full custody? I don't see why your mother couldn't care for your child while you were in basic training, but she doesn't necessarily have to have -- and it's "joint" custody -- with you. She can be a caretaker while you're away. As for the girl's father, he would have to have a better reason to get full custody. Talk to your attorney and he/she can give you the answers you're seeking. Good luck!

I am assuming you are talking about the US Army. The Army will require that you give someone legal custody of your child while you are in training. Once you depart training, you will have to make arrangements to care for the child when you are working and upon deployment for training or combat, you will have to transfer legal custody to someone else so that the child is cared for in your absence. This complication may prevent you from joining.

Your x-husband could try to get custody but it will not go through. And as to your mother having your custody until you get out of training as long as your x-husband agrees to it there shouldn't be any problems. To find out more ask your husband to take you to talk to a JAG officer on base. They will be able to find out the answer to all your questions.

you cannot go Active duty with a spouse who is already in and chiildren. you can only go Reserves.
if you want to go AD, you would have to give up complete custody to your Ex. you would not be allowed to get any kind fo custody back until the end of your first term of enlistment. you wou;d not be able to give your Mom custody without the Exs permission.

Her dad can go after custody. IF you were to die, she would go to her dad's. You can't specify in a will where that child goes....
