Okay...so let's say we're in Spain...would a minor go to jail for killing someone in self defense?

To the person who asked...no, he was not armed...no, he was to strong and heavy for her to get away...no, they were not dating. He was her stepfather (even though she thought he was her real father)...and no, I refuse to go to Yahoo! Spain.

Besides, she didn't mean to kill him...It was supposed to be a threat. the end

While I'm not really trained in foreign or international law, in most modernized countries you would be hard pressed to find a court that would convict a minor of a a malicious homicide when she was under the fear of great bodily injury or death.

Was he armed? Was she in fear for her life? Could she have just run away and not killed him? Were they dating? A question like this is meaningless without the facts associated with it. Why Spain? Perhaps you should go to the Spain Yahoo and ask this.

Minors aren't sent to jail. Self defence for rape if proved is enough for an honourable aquittal anywhere in the world except the Islamic states, i think.

If it is self defense, and if you are in a civilized country, then no. But there are these third world countries I am not sure of.

Minor or not, I would never send anyone to jail for killing a rapist.

WELL MINORS CANT BE TRIED (I THINK) UNTIL THEY REACH A CERTAIN AGE. ALSO KILLING SOME1 IN SELF DEFENCE IS MORE THAN ENOUGH FOR A COURT ROOM OF PEOPLE 2 UNDERSTAND.

If it was the U.S. then no she wouldnt be arrested but Spains laws are differernt.
