ok this what happend i turned in to a street but made it lil wide so i went down the street and parked n shut the car off as i got out the cop pulles up and puts his spot light on the car but he never said nothing he walked up to me n said i am pulling u over . ok then he accused me of being drunk just cause my yes were red n glossy . i had nothing to drink i even did a breath test n blew 000, then the officer that said he pulled me over handed the stuff over to another officer that wasnt even there . so what i am asking did he still have the rite to give me a ticket

got the ticket for inproper turn . really cant see how he can pull me over cause he never did .

he can give you a ticket for anything, most people don't fight themand the state takes in millions in revenue. go to court and you will definately beat that since the issuing officer wasn't the one who pulled you over

Yes, the officer has the right to issue you a citation, if you've committed an offense.

If you don't think you deserved the ticket, tell the judge what happened, and the court will decide.

You don't say what he wrote a ticket for, but if they suspected you were driving drunk strongly enough to give you a breathalyzer, you must have been up to something.

There is a good chance you can influence the cop to just not show up at court and you can win because the officer didn't show up at court. You have the right to request another court date, he will need to adjust his schedule to attend court on your preferred requested day, and perhaps he will need to convince his partner to adjust his schedule also, so they can attend court and possibly give testimony about your alleged offense.

After requesting another court date, and you do show up for that day, if by any chance the officer does show up... you should appear as a solid good citizen, humble is best. Clean clothes, no sweat-shirts, jeans or cool clothes. Look like you are going to visit your grandma.

Talk to the judge in a humble manner. You really do respect people who serve the community as police officers. They see us citizens when we are not at our best behaviors.

In this particular case, the officer had a view which was obstructed by the angle he was looking at you. And the dark background made it difficult for the officer in this case; to accurately see the situation.

You really did obey the law. The officer's view from his location made it difficult for him to see accurately.

You only need to inject a bit of doubt to the officers story. As you know, he must prove guild beyond a reasonable doubt you committed this offense. You just need to inject plausible doubt and you will be free.

I have given you two opportunities to be relieved of this burden. Following thru with these two scenarios should be enough punishment inflicted upon you so that you will know to avoid doing this again.

There is a good chance the officer won't show up, as he needed to attend court just to testify at your case only this day as his normal court day is ...(?monday?)

He can right you for anything. There is no proper way to pull somebody over. There are safer ways to people over but he doesnt have to be nice or mean. He can do it how he wants unless he is charging you for things you didnt do.

A ticket for what? You said you passed the breathalizer test.
