he is not on the birth certificate and he has another family that he cares for and has ignored this child with me (I don't care for child support just want to terminate his rights and it is not for adopting purposes.)To top it off a lawyer will charge me about $200 to $500 an hour and legal aid was no help either... I can file myself but don't know what to do afterwards. Any advice? By the way this is for the state of Florida

Have you asked him to sign away rights? Its a lot easier if he willingly relinquishes rights.

If he won't agree, tell him you will hit him for support (including arrearages). Bet he signs then.

If you file without his consent, you will receive a court date in the mail or in person. Once you have your date, show up and tell the judge why you want rights terminated.

As frustrating as it may be, you have to contact the biological father to make sure he's ok with it. Regardless of whether he's on the birth certificate or not, regardless of whether he's a dead beat dad or not. He may one day grow up enough to realize what he's been missing and who he's been hurting. If you go ahead & are able to do it without his signing his rights over, he may be entitled to take legal action later on. I don't know. Besides, your child deserves a link to his birth father even if nothing ever comes of it. It honestly seems like a way of punishing him that you're looking for. But though it may make you feel better, is it going to benefit your child in any way?

Termination of parental rights has to be approved by a judge. Unless Dad's completely unfit/a danger to the child or you have a husband who’s willing to adopt, it probably won’t happen. Judges, as a general rule, do not like to leave a child fatherless (for many reasons).

If he ignores your child and is not on the birth certificate and you do not wish the child support why do you wont to terminate hes rights when he is not taking any!.You can never take the DNA away.

he has to sign the rights away in court, if he agrees thats fine... if not, he will at least have to pay your support
