S Can i stil file criminal charges, and civil?
Many of you are going to read this and call me stupid but here it is. My ex boy friend thought that I was cheating on him (which he came to find out later that I didn't) that was after he came to my house destroyed over 5 thousand dollars worth of things. Including my 50 inch big screen. Then proceeded to slap me. I filed a police report but didn't follow up on it, because like some people ( people I use to call stupid) I blamed myself. I no longer feel that way, I think he should have to pay financially and criminally for what he did. Since its about 2 months so long do you think I could get compensation for the damages? I have a witness who saw him hit me and break all those things. I just dont know if its too late.

I would advise you to file criminal charges first before suing him in civil court. If it has only been two months, then you should have plenty of time to do both. If he is convicted of the criminal charges, the court can make him pay restitution.

Want do you want ? Criminal charges on this guy? If yes then go file charges it is not too late. Be prepared though for some Police Officers to be hesitant in writing a report and filing criminal charges, most Officers prefer that this happen at the time of the incident. Do you want to sue for damages? If so consult your local bar association or look up small claims court for your area. Look under "pro se court" too. Some states have monetary limits and most will not allow you to sue for the actual cost of replacing your propertyy. Filing a claim is very inexpensive around $100. - 200.00 at most. Before court have as much documentation on your property purchases as possible. Get a copy of the police report and witnesses or statements and go after this jerk. Good luck, you will prevail.

In agreement with Robbocop...the slap was an assault (misdemeanor) of which technically you have up to a year to file. Waiting that long, however, is not a wise move. The longer you wait...the more inclined the court is to think the offense wasn't that important.

It's not been that long since the event occurred...and being a domestic violence issue...you need to act quickly from this point forward.

Insure when you file your complaint that your witness is included so that they can appear in court on your behalf as well!

You're doing the right thing by sending him on his way as there is no question that there are better "fish" in the sea!

Absolutely! If it's only two months ago, yes, you can still sue. Depending what state you live in it's anywhere between 1-7 years before it would be too late.

just go back to police station. i am sure they can do something. and they wont ask for money so no harm in trying
