I own my own home and out the front is a power pole, the neighbours on either side of me have there power and phone lines crossing my driveway at a height of 3 metres but it makes it impossible for me to use my driveway as I own a truckwith a 4.2 metre clearance, is there anyway I can make the power/telephone company not have there wires cross my property to service others

It would be difficult to supply power without crossing property lines. It is reasonable on the other hand to expect to use your driveway. However that is quite a large truck. And it is presumably not zoned commercial. I wouldn't give odds either way in a litigation but the power company might well accomodate your wishes as a gesture of good will if it is not too impractical to do so.

Without knowing which state you are from or searching the record of the title to your property, I can not give you a certain answer but the following is probably true.

A long time ago, as a condition of getting phone service/electrical power or in exchange for good old fashioned cash or "other valuable considerations," the owner of your property gave the utility company an easement. That easement probably expressly gives the utility company the right to place power lines in the air above your land.

Without knowing any particulars of the easement which might expressly address this issue, if the easement is silent as to height, a court would probably interpret that easement as allowing reasonable use. If the lines have been there for any length of time, it will be difficult for you to show that 3 meters is unreasonable.

As always you should contact an attorney to have him review any easements on your title to see if you have any legal remedy. There is a chance that your only remedy may be to move your driveway further away from your lot line.

Well I am sure there is a measure of safety that they would have to go by.

I would approach it this way. I would call the power company and explain that at 3 meters it is dangerous and it is likely that these lines get hit and you are sure that it would be a situation that no one would want to happen should those power lines get pulled loose and kill someone and it would be in everyones best interest if they adjusted them to a height that was safe.

Give it a try. nothing like fear of bad publicity or legal action to get them off their butt.

Actually, they probably have an easment of necessity that is attached as a covenant with the property you purchased. You can certainly ask for some type of alteration, but you may be charged for the change as you have an extraordinary cirsumstance giving rise to the issue.

The fact that you spelled it neighboUrs and used metres makes me think I have no clue what the laws are in your country because it's doubtful you are in the US. Good luck

Nope. it's an easement. You might ask the power co to raise the wires, but they make the final call.
