Honor the check and if you have PROOF then take him to small claims court to recover. You can also notify the Bar Association of your claim for substandard representation. But the key element is PROOF. And the burden of that PROOF is on you not him.

Appearances by phone are becoming very common. Can you prove he was drunk? Did you have a bad outcome?

If your attorney represented you when he was drunk, you can file a complaint with the BAR association. Dont bother stopping payment. The check is already processed. If you stop payment without cause, he can sue you. Get your ducks in order and file a complaint.

Brunette, you DO have a right to a competent attorney in criminal cases.

You can stop payment on the check for any reason. I believe your question is actually about your attorney coming after you for non-payment.

If that is the case, your best bet would be so see an attorney.

No. You can only legally stop payment on a check if the check was stolen. Otherwise its like writing a bad check or dishonoring a check. He could probably sue you for it and win.

Report this to your State Bar Association.Probably wont do any good,but might make you feel better.Priest,Lawyers,Police ,and Judges,have the highest per capita alcohol abuse in the nation.I've had that, drunk damned Lawyer stuff, myself

You have a right to a lawyer.. not a competent one.

But in all honesty, I would do it but you will probably end up in court (again) over it.

yeah, you can put a stop to any check, but you might still owe them money.
