The responsibility definitely lies on both the citizens and the officials. The officials need to properly enforce the laws and regulations but at the same time the citizens need to make sure that the officials are doing their job. Each group needs to check the other.

It is the responsibility of the people. Since the government is controlled by the people, its failure or success is a direct result of the electorate. The government is just a human invention.
The government derives its right to govern from the consent of the governed. The Bill of Rights only holds weight if the citizens force their governments into complience.
If our government sucks, and many people of all political leanings think it is currupt and bordering on the ridiculous, it is because we the people have allowed it to become that way.

Interesting question. I'd say a combination of citizens and government. But, either could go corrupt, so what keeps them from doing that? I'd say personal responsibility, or at least enough to prevent total chaos. It's hard to say though, because then you can get into a debate about the nature of man: Does man do what he thinks he can get away with, or does man naturally want to do what's right? This could almost go into the Philosophy section. :)

You're right. All things being equal the courts dispense justice but its up to all of the branches of government and the vigilance of citizens to maintain it.
