They can be subpoenaed to give a DNA sample which usually consists of a swab of the inner cheek or blood. If they refuse they are charged with contempt of court and subject to being incarcerated.

Yes, as long as they have a subpoena from the Court, which means the prosecutor would need substantial (not overwhelming) evidence linking the individual to the crime and then they would issue an order, get the judge to sign it.
Of course, if this happened you would need a lawyer to find on behalf of the suspect since this is highly intrusive.
A subpoena for blood is much easier!

Just like you see on CSI or Law and Order - there has to be a warrant.

If you refuse, it will taken from your forcefully.

Not an attorney but I do watch way too much crime TV.

No they use blood or DNA. How are you supposed to 'donate' a sperm sample while a cop is watching. I amv sure there are a few who go for that sort of thing.

they need sperm b/c it could have been left in the victim and it is a quicker process than blood test. if you are only suspected and you refuse they can't do anything. but, then again, if you refuse them you b/c even more of a suspect...

Why on earth would you even remotely think the police would want sperm?

Umm - of you want DNA you get blood or mucosa - not sperm. You can't identify sperm in a line up!

No, Why would they want it anyway??
For DNA a mouth swab is all thats necessary.
If they refuse, I'm sure they would take that as an admission of guilt, albeit circumstantial

in extreme cases maybe,but usually a DNA sample can be obtained in easier ways. they can do it by court order and you can be jailed for not complying with a court order
