Here is the scenario...a divorce situation, but paperwork isn't filed yet. The lease in an apartment is up in a month. The husband is moving out, says he wants to take the kids (one an infant, the other 2 years old), the mom doesn't agree to it. He says he is going to shut the power, phones, etc when he moves out. She spends all day trying to find a job, has yet to find one. Only family she has to move in with is out of state. What can/should she do? It sounds like he is abandoning them.

For clarification, she has been looking for a job for over a month. Also, her family would only put her up with a place to stay in another state, but in no way support the idea of a divorce (very traditional), so they aren't giving any financial assistance.

A lawyer is needed here. He can't legally shut off the power to the homestead, nor can he take the kids from it. But, he can leave, and by the time the lawyer gets to court with the battle over the power situation, it will already have been shut-off for awhile. So the wife simply needs to find a way to pay that bill during that time.
The wife can't move out of state without her husband's permission, so forget that idea.
She may spend all day trying to find a job, but it sounds like it is time to work for a burger joint, because a bad job with income is better than no income at all. Besides, she needs to hire that lawyer, and quick!
When the lease is up, she will need to move somewhere in the state, usually within a hundred miles of the apartment. If a new lease isn't signed, then he can try to take the kids without her consent, because there will be no homestead. So she had better get some help from family, or some other method of immediate cash, and quick.

This is a custody issue and if those kids are left without power don't be suprised if the judge puts them into foster care until mommy and daddy grow up.

What kind of person would shut the power off on his own kids?

One thing she might do is find a local shelter for abused moms, thats abuse and it will go a long ways towards making sure that daddy never gets those kids again. So have her contact someone.

First of all I am a 60 year old male. The sob is applying a good offense in order to establish a good defense. One thing you can do is to establish dignity for yourself. If you do not it is downhill from here on in my dear. Nobody but nobody has a right to call you a whore. For a start you should accept no less that an apology and a commitment to never call you a name again. You can also tell him that if he cheats on you again you will get a divorce and sue him for every penny he has - please tell him I said so. You are a human being and deserve to be treated like one.

Call social services in your county they should be able to stop this from happening, they sometimes can even help with finding a job especially for a single mom who is being threatened, also notify the police of his threats.

You get the electricity turned on in your name, get a cell phone and borrow money from family until you get on your feet. Keep looking for a job...It takes more than ONE day of job hunting.

tell the police, that the man is threatening her of taking power.
go to divorce house.
take your children to their grandparents house, and live with your parents once police figure something out and offer to take you there in some way.

He is using the children to punish the wife. And he is abandoning....... she should maybe go to welfare office for help until she can find a job.

make sure you're the benificiary on the life insurance and that it is paid up, then have him whacked
