if i refinance alone i will get 8 +% interest rate. my co-signer already lives in the house, and we should be able to get a ower occupy loan, with a lower interest rate.

If your co-signer is willing to live with the financial liability of a mortgage with no ownership interest, yes, you can do that. Not the wisest thing on your co-signer's part, though.
