I was reading the Toronto Star (Canadian Paper) and it had an article about some famous teacher charged with having sex with a 14 yr old student.

But then it said that sex between an adult and a child 14 yrs old and over is LEGAL as long as the adult is not in a position of authority over her.

Do you think its a misprint on the papers part cause I dont think its legal. Does anyone know or is this craziness true?

Remember ADULT is someone is 18 and over. So we are not talking a 14 yr old with a 16 yr old. But rather according to the paper... a 14 yr old with a 41 yr old.

The Criminal Code does not now criminalize consensual sexual activity with or between persons 14 or over, unless it takes place in a relationship of trust or dependency, in which case sexual activity with persons over 14 but under 18 can constitute an offence, notwithstanding their consent. Even consensual activity with those under 14 but over 12 may not be an offence if the accused is under 16 and less than two years older than the complainant. The exception, of course, is anal intercourse, to which unmarried persons under 18 cannot legally consent, although both the Ontario Court of Appeal(3) and the Quebec Court of Appeal(4) have struck down the relevant section of the Criminal Code.

The age of consent for sexual activity in Canada is 14. Under Canadian law, 14-year-olds are legally considered consenting adults. Moreover, in Canada, consensual activity with those over 12 may not be an offense if the accused is under 16 and less than two years older than the complainant. The exception is anal intercourse, to which unmarried persons under 18 cannot legally consent according to national law, although provincial laws may vary.

That all depends on what your state or country considers "The Age of Consent", meaning the age a person can make rational informed decisions about sex or procreation. This only applies when one potential partner is appreciably old than the other. If one partner is past the age of consent and the other is not, this is considered "statuatory rape" in most places.

States in the US have different ages of consent, some as low as 15, some as high as 18, but personally, 14 seems a little too young to be considered "rational and informed".

The age of sexual consent should be tied to drinking age, voting age, etc. If you are too young to enter into a legally binding contract, you are too young for a sexual relationship.
