Your headlights are supposed to be on from 1 hour before sunset to 1 hour after sunrise. The "it wasn't that dark" excuse isn't going to hold up in court.
And If your vehicle is being operated, it doesn't matter how close or how far away from your starting point you are, all laws still apply.

Depending on the level of darkness that your areas experiences during the day of the year, this could make all the difference. It isn't important how long you've been driving, since according to the law, if you are driving with your lights off, it makes no difference if you were just pulling out, or if they were off for half an hour. What you should've done is take a picture if possible, or have a local bistander attest to the level of light outside. As far as the law is concerned, 9:00 constitutes night time, and they should be on regaurdless if we as drivers find them nessisary based on the light level. My suggestion is to take it to court and adress the situation as it wasn't yet dark enough to need them, and i'm sure you'll have a reduction of the fine, and withheld judication, however this obviously depends on the leaniency of the judge, and your previous driving record. I'm unsure of other states, but i know that in Florida, if it's been over 2 years since your last ticket of less severity than reckless driving, they withhold judication if you plead no contest.
Furthermore if you timne isn't worth going to court for the day, then just pay the dine.

What you did was illegal, 9 PM other drives need to see you better, that's why the laws says at dusk or inclement weather your lights must be on, you have no grounds to protest the ticket on. If you do fright the ticket Court Cost will be added to the fine as well and the judge will give you a talking to as well. Plus your going to wast all that time in court as well!

You aren't allowed to rive 2 feet after sun set, let alone two miles. If it was after dusk (about 6 pm in CA) then you were driving illegally. They don't usually pull people over until about 30 minutes after dusk here though.

Yeah, just pay the fine. We all know you did not mean to drive with your lights off, but it happened. I'm sure your not the only one it has happened to either.
