I hit a woman from behind yesterday. She was in front of me at a light and got pissed that I honked at her to go when the light turned green and she wasn’t paying attention, so she did a break-job in the middle of the intersection. I hit her of course, but then she left the scene of the accident. My question is, if she stayed would it be both of our faults since I hit her from behind and she intentionally caused a wreck?

If this was the case, a good investigator would see that this was a forced accident. Both parties should be ticketed, and brought to court. Even though you are the striking vehicle(#1), you may be able to prove that vehicle #2 caused the accident.

If you hit someone from behind it is, by law, automatically your fault. If she left the scene, it was probably because she didn't have a driver's license, or no insurance, expired tags, illegal, etc. If that was the case then she would be at fault because she shouldn't have been driving in the first place...she would have gone to jail. Since she left the scene, your not responsible for any claim she might make going forward. Your insurance should still cover your vehicle if the damage is higher than the amount of your yearly deductible.

Do you know what happens in cities where drivers leave lots of room between themselves and the car ahead?

A perpetual traffic-jam at every intersection.

At every green light, more comes join the rear of the lane line than depart from the front of it.

If people don't crowd a bit when leaving intersections, the traffic system in many urban places won't work.

Which means...

People get habituated to trusting the driver ahead of them not to do "a brake-job." That is, evil people who want to cause accidents by slamming on their brakes will nearly always be able to do so, in cities at busy intersections.

The law frequently is stupid. Or, worse, it is malicious. It defines an operational right and wrong that can't possibly be made to work justly, and then it denies that its definition is unjust. And what are you going to do about it? Unless you're God, you can't put the judge and the law-makers into Hell over it.

You are in control of the vehicle you drive. Like the captain of a ship you are responsible for everything it does and what is in it. If any damage was done to her vehicle and word got out that it was intentional, you could be looking at malicious destruction of property.

Nope,

If you rear end anyone, it's always the fault of the driver behind.

You are supposed to leave enough room between your car and the car in front, to give yourself room to stop , if they hit their brakes.

You evidently didn't do that.

Yes, it would have been your fault, its always the fault of the driver behind.

Sorry, it would be your fault. Sounds like you were tailgaiting her.
