sayin that she is custodial parent of the common child but that is not true because the child is in state custody so the judge only heard her side which is lies and i got kicked out of my house she just got out of jail for punching me and then she went and got a restraing order just so she can have a plce to stay but in the guidelines of her being released from jail there was a no contact order that she wasnt supposed to come around me and so when i got off work tonite a cop came to my home with papers telling me i had to leave should i go to the courthouse tommorow morning and talk to someone maybe state attorneys office? or what if i filed a restraing order on her would i get the house back or what?

You are beyond the help of a simple question on Yahoo Answers, you need to hire an attorney for this convoluted mess.

Short answer is you need to find another place to live as soon as possible (don't be shy about agreeing to a 6 month lease as it will take at least that long) as she beat you to the punch and it will take a long time to sort it out in Court.

Also, stay away and have no contact with her. To get your things out of the apartment, arrange it through the Sherriff's Department.

By issuing a restraining order, she is not to contact you either. Get a notebook and write down any attempts of contact that she tries to make with you to show that if she is so afraid of you, why does she still try to keep contacting you.

It is sad that both of you seem more interested in seeking vengeance against each other when you both should be focused on doing what is best for the child you created together, which is probably why the child is in State's custody now. It sounds like you both need to counseling to learn to deal with anger and be responsible parents. It is no longer all about you (or just her) anymore, it is about the child...you both need to grow up.

You have no control over what she does, but you do over what you do. Regardless of whatever feeling and anger you have towards her, she is always going to be the mother of your child. As she resorted to chidlish petty control tactics and hit you, it sounds like you are more on your way to being responsible than she is. Stay the course in taking the high road and you will be better off in the long run and the Courts will be more likely to favor you over her.

tough one... I would suggest that you get a TRO also being that she is the one who assaulted you, because even though she filed it I guarantee you that SHE will harass you.. the best thing for you to do is not to act on or speak on impulse, choose your words carefully cause it could be used against you, let her look like the crazy person.. my advice to you would to keep as calm as possible and do not do anything that will cause someone to question your character. Also do not use your children against each other.. you are automatically in the wrong if you are doing this. Remember the issue is YOU and HER.. the kids will always love you both, don't talk bad about each other to the kids.. Get that restraining order and custody of the child can then get established. in about 2 weeks there would be a court hearing where then you can state your case.

You need a lawyer. Go to Legal Aid if you can't afford one. I was going to tell you that it didn't matter if she lied, just stay away from her; that's simple. But if you got kicked out of a home you are paying for you need a lawyer to get back in.

Like your last question, these are all things to bring up with the judge. No cop, prosecutor, attorney general, people on yahoo can do anything about it. The judge only one that can do anything with the order.

Filing one against her won't do anything.

That is not your girlfriend...that is a she-demon. Whenever you think your girl is going crazy it is time to ditch her...next time put a restraining order on her first. My buddy just put a restraining order on his ex-girlfriend. And since she has done nothing but call him and beg for him. Maybe you shouldn't have let her get on top. That is your job.

Get a lawyer, legal aid is usually free. Hang in there, I have been there and its scary but you should pull through with legal assistance.
