My guess would be suicide. Attempting to commit suicide is punishable, and I know at least in Wisconsin a person is required to go to a mental hospital until the hearing. However, committing suicide is not punishable because the person is dead and therefore cannot be punished for committing the act.

well i know that the act of committing suicide is illegal, but that's only so that no one can legally help someone else commit suicide. but (god forbid) someone succeeds, they aren't charged. if someone helps someone else commit suicide, though, they are charged. the act of commiting suicide is only illegal because it technically has to to make assitance illegal. but that doesn't quite fit the bill here. its a really good riddle.
