Going behind a moving car is just stupid. Always, when I see a car starting to back out, I stop far enough back he/she can turn enough to drive away. Unfortunately we all have to watch closely for the idiots that think the world revolves around them, and they shouldn't have to stop or slow down for anybody else. And don't worry about the right-of-way talk. Parking lots are not covered by highway or municipal traffic laws. Unless there are unimpeachable witnesses, evidence of drinking, etc, insurance companies tend to automatically class parking lot accidents as 50-50.

I think these inconsiderate people are getting too close to you because they’re fearful some other driver is going to take the space that they want, (that you’re pulling out of). I, personally will creep up to the person coming out of the space I want but I’ll make sure to give a car and a half to 2 car length opening between myself and the car pulling out so the vehicle pulling out has enough room to maneuver and leave the lot. It’s simple courtesy however; I believe some people are a little too greedy when it comes to parking spaces. Ever notice the people that are roaming the parking area for a closer parking spot (like sharks) are people that should actually be parking further away as they need the exercise!

Moving vehicles have the right of way. That being said, so what??
Personally, I stop. I have no idea whether they will or not, so i stop and let them proceed. As a result, they proceed and go on their way, and after a delay of a few insignifiant seconds,so do I.
If you get involved in an accident arguing who is right and who is wrong is not going to repair any damage or eliminate the cost, aggrivation and inconvenience. If a person can't spare a few seconds to avoid a potential accident, they shouldn't be driving.

The vehicle moving in the traffic lane has the right-of-way over the vehicle that's backing out of a parking space. Some drivers are courteous enough to let you out of your space with no fuss, but you must give way to those who don't want to wait for you. If you were to hit them, it would still be your fault.

well the car that is driving through has the right-of-way. think of it this way, if you are backing out of your drive way into the road, are you expected to stop or is oncoming traffic? obviously you. now if the driver that driving through the parking lot see's you backing out and doesnt proceed with caution, then legally you are both at fault. but jeez, you think they would WANT to wait so they could get your parking space!

Yeah some people don't have any social skills, but watch out If your reverse lights are on when you get in an accident it's your fault.
