I believe you have got it wrong ! Congress doesn't have a voice on who's accepted and/or rejected in the American Legion. This decision is up to each post, with final decision made by the post commander !

Here are the rules for eligibility to the American Legion:
Any person will be eligible for membership who was a member of the Army, Navy, Marine Corps, Coast Guard or Air Force of the United States and assigned to active duty at some time during any of the following periods:
April 6, 1917 to November 11, 1918... (World War I)
December 7, 1941 to December 31, 1946... (World War II)
(U.S. Merchant Marine eligible only from December 7, 1941 to August 16, 1945)
June 25, 1950 to January 31, 1955... (Korean War)
December 22, 1961 to May 7, 1975... (Vietnam War)
August 24, 1982 to July 31, 1984... (Lebanon/Grenada)
December 20, 1989 to January 31, 1990... (Operation Just Cause-Panama)
August 2, 1990 to Today (Operation Desert Shield/Storm)...or cessation of hostilities as determined by the Government of the United States.
Who told you Korea and Vietnam were not included?

The American Legion was chartered by Congress in 1919. Congress sets the membership eligibility based on what the war years are. Here is a link to a petition to include Cold War vets.

The AMVETS is for all Veterans. The Legion is a "War Time" organization so some definition of a "war" had to be going on for one to join. Why do people want to join the Legion anyway, to drink beer? Actually the Legion is too much work, after all they are an organization of "volunteerism".

The government does not make up the rules for the american legion.....the legion is a privtely run organization that has no affiliation with the federal government. If the legion is not allowing them to join ....those are the legions rules

The Korean War is not over, so if you where in a job that supported Korea you are eligible. That is how I was a cold war vet and got into the VFW.
