to my qestion there were fall precations in place and we feel that they treat the medicare patients far different then private pay now we have to put her in a home what can i do so this dose not happen to anyone else.

well, if all precautions were taken then no, you don't have a case.
As to your other concern it is likely unfounded. The nursing staff treats all residents the same. the CNAs and many of the nurses are often not even aware of how a person is paying. To treat one person better than another because of how they are paying is neglect and grounds for a lawsuit, so they do not do this because they don't want to get sued.
This WILL happen to someone else. The elderly are many times reluctant to ask for help when they need it, maybe because they are to stubborn, some don't want to be a bother, some are suffering from dementia. Occasionally the call light gets wrapped up in the covers and they can't find it, so they get up and go the bathroom on their own. We could avoid all falls by tying them down to their beds, but do you really want to treat Grandma like a prisoner? It is a delicate balance between balancing safety and freedom, and people will still fall on occaision.

Lots of luck with that. Elderly women in nursing homes are always breaking hips. The incidence can be decreased a little with fall precautions, but there's no way to limit them greatly. They often appear to fall and break a hip when in actuality they break a hip and fall. That is, they're frequently osteopenic, and the bones break with as little external injury as a normal step, or just standing still. It is true that Medicare rules limit the treatment of nursing home patients, but that's really true whether they have private co-insurance or not, so it's likely that any biases you've seen are personal rather than because of insurance status.

Th best way to find out is talk to a lawyer and explain the whole thing.

Sometimes, though, old people fall even if there are precautions. Talk the the woman for her story, if she is lucid. I am not defending anyone but please be careful before you jump on the lawsuit bandwagon.

Talk to several lawyers. If anyone is willing to take this case on a contingency basis, you have a case.

If you go to court using your own money, you may lose it all.
