Sure, anyone can open a tax office, but make sure either you have the qualifications to prepare taxes, or that you hire people who have the qualifications to prepare them. Otherwise, you're in for a lot of liability if you don't know what you're doing.

Not really. You need to be trained to actually do taxes. As a preparer their are certain legal obligations that you have to uphold. If you don't uphold them you can be fined or jailed plus you client could be too. Now you can open a franchise of a tax service. The companies will actually train you and give you support during this process. But if something goes wrong as seen with a Jackson Hewitt this year, the franchisee can be penalized too.

California and Oregon, as of now, are the only states with licensing requirements.

In the other states, anyone can hang their shingle as a tax preparer. Though, if you do not have the training and/or experience, it may be a bit difficult to attract clients.

Federal legislation mandating licensing has been rumored for the past few years but nothing has passed yet.

Other than in the state of California and Oregon you need only the resources to identify your self as a Tax Preparer and you are one.
