My mom doesn't have any income in the states, just overseas she yearly sales some property and pays the tax over there and she uses the money overe here in california, we learned that even though she doesn't have income she has to file for tax, it's been 2 years we are leaving in california, when should we file for her? the sooner the better, is it too late now? or there is a specific time.cause for her citizenship we want everything to be correct.

Assuming that she's a US citizen or resident, she certainly DOES have taxable income in the US. She needs to file any missing tax returns and pay the taxes due. You cannot do that for her unless she gives you Power of Attorney to do so.

Get a copy of IRS Pub 54 from the IRS website. It will explain everthing.

If she is here illegally why worry about it the immigration issue is never going to get resolved.
